1. Agreement to Terms

These Terms & Conditions (the “Terms”) form a binding agreement between you and Godspeed T-Shirts (“Godspeed,” “we,” “us,” or “our”) regarding your use of godspeedtshirts.com (the “Site”) and any purchase of products. If you do not agree, do not access or use the Site.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to purchase from the Site. By placing an order, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

3. Accounts & Security

  • You may browse without an account, but certain features may require registration.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts for any reason, including suspected fraud or abuse.

4. Product Information & Availability

  • We strive to display accurate product details, measurements, and colors. Actual colors may vary due to device display settings and garment-dye variations.
  • Releases are often limited. Items in your cart are not reserved until checkout is completed and you receive an order confirmation.
  • We may limit quantities per order, per household, or per customer to protect fairness in limited drops.

5. Orders & Payments

  • By submitting an order, you offer to purchase the products selected under these Terms.
  • We accept major credit/debit cards and other methods displayed at checkout. You authorize us (or our payment processor) to charge your selected payment method.
  • Orders are accepted when we send a confirmation email. We may cancel or refuse any order for reasons including suspected fraud, inability to verify payment, or product unavailability. If payment has been captured for a canceled order, we will issue a refund to the original method.

6. Pricing, Taxes & Currency

  • Prices are listed in U.S. Dollars (USD) unless stated otherwise and are subject to change without notice.
  • Sales tax will be applied where required by law. Duties and import fees for international orders are the customer’s responsibility unless stated otherwise at checkout.

7. Shipping & Delivery

  • Estimated processing times and carrier transit windows are shown at checkout and on our Shipping Information page.
  • Risk of loss passes to you upon our delivery of the order to the carrier. Please ensure your shipping address is complete and accurate.
  • We are not responsible for delays caused by carriers, customs, weather, or events beyond our control.

8. Returns, Exchanges & Cancellations

  • Please review our Refund & Returns Policy for full details, timelines, and item conditions.
  • To be eligible, items must generally be unworn, unwashed, and in original condition with tags intact. Final sale items, limited releases, and certain promotions may be ineligible.
  • Orders may be canceled prior to fulfillment where possible. Once shipped, standard return procedures apply.
  • In the event of any conflict between these Terms and our Refund & Returns Policy, the Refund & Returns Policy controls.

9. Preorders & Limited Drops

  • Preorder shipping windows are estimates and may shift due to production schedules or quality control checks.
  • We may limit units per customer to maintain equitable access. Multiple orders deemed to circumvent limits may be canceled.

10. Authenticity & Condition

  • We stand behind the authenticity of our products. See our FAQ on authenticity for more on sourcing and verification.
  • Minor variances in print placement, dye tone, or fabric hand feel are normal with garment-dyed and screen-printed pieces.

11. Sizing, Measurements & Care

  • Measurements provided per listing are approximate and taken flat. Please allow tolerances typical of cut-and-sew garments.
  • Care: wash cold, inside out; air dry or tumble low to protect print and preserve garment quality.

12. Acceptable Use

  • Do not use the Site for unlawful, fraudulent, infringing, or harmful activities.
  • Do not interfere with Site security, attempt to access accounts or systems without authorization, or use automated means to scrape or harvest data without our written consent.

13. Intellectual Property

All content on the Site—including text, graphics, logos, images, product names, and designs—is owned by or licensed to Godspeed T-Shirts and protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

14. Reviews & User-Generated Content

  • By posting reviews, photos, or other content (“UGC”), you grant Godspeed T-Shirts a non-exclusive, worldwide, royalty-free license to use, reproduce, display, modify, and distribute such UGC in any media for marketing and operational purposes.
  • You represent that you own or have rights to the UGC and that it does not infringe others’ rights or contain unlawful material.

15. Promotions, Discounts & Gift Cards

  • Promotions are subject to their stated terms. Unless specified, offers cannot be combined and exclude gift cards and prior purchases.
  • We reserve the right to modify or end promotions at any time.
  • Gift cards are nonrefundable and redeemable only on the Site, subject to applicable law.

16. Third-Party Links & Services

The Site may link to third-party websites or services. We are not responsible for their content, policies, or practices. Access them at your own risk and review their terms and privacy policies.

17. Errors, Inaccuracies & Availability

Occasionally information on the Site may contain typographical errors, inaccuracies, or omissions related to descriptions, pricing, availability, or shipping. We reserve the right to correct any errors and to change or update information at any time without prior notice, including after you submit an order.

18. International Orders & Duties

  • International shipments may be subject to customs inspections, duties, and taxes imposed by the destination country. These fees are your responsibility unless otherwise stated.
  • We cannot guarantee delivery timelines due to customs processes.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your information.

To the maximum extent permitted by law, Godspeed T-Shirts and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or purchase of products. Our total liability for any claim shall not exceed the amount you paid for the applicable product giving rise to the claim.

You agree to defend, indemnify, and hold harmless Godspeed T-Shirts from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

24. Governing Law & Venue

These Terms and any dispute will be governed by the laws of the State of New York, without regard to conflict of law principles. Subject to the arbitration provision below, you agree to the exclusive jurisdiction of state and federal courts located in New York County, New York.

25. Dispute Resolution & Arbitration

  • Except for claims that qualify for small claims court and claims for injunctive relief, any dispute arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration on an individual basis under the Commercial Arbitration Rules of the American Arbitration Association. The arbitration will be held in New York, NY.
  • Class actions and class arbitrations are not permitted. You and Godspeed T-Shirts each waive the right to a jury trial.

26. Changes to Terms

We may update these Terms at any time. The “Last updated” date reflects the latest revision. Continued use of the Site after changes become effective constitutes your acceptance.

27. Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions will remain in full force.
  • Entire Agreement: These Terms, along with policies referenced herein (including our Privacy Policy, Shipping Information, and Refund & Returns Policy), constitute the entire agreement between you and us regarding the Site and products.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
  • Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
  • Electronic Communications: You consent to receive communications from us electronically (e.g., email, Site notices) and agree such communications satisfy any legal requirement that they be in writing.
